1. Provider
These terms of use (“Terms”) are issued by Pascal BEN BIHI, sole trader trading as FRENCH DIGITAL (brands “ICodePlugins” and “Fais Mon Site Pro”), registered in the French National Business Register under SIREN 501 078 083 (SIRET 501 078 083 00034, APE code 1813Z), registered office: 10 rue de la Barre, 66000 Perpignan, France. 2. Purpose and Scope
These Terms govern the use of the plugins, themes and services offered by ICodePlugins (the “Products”), including the push-notification service and its hosted relay server (the “Relay Service”). They complement, and do not replace, the General Terms and Conditions of Sale (governing purchase) and the Privacy Policy (governing personal data).
3. Definitions
“Customer”: any person installing or using a Product. “Subscriber”: the end user of a Customer’s site (e.g. a notification recipient). “License key”: the activation identifier we provide. “Relay Service”: the hosted infrastructure sending push notifications via Firebase Cloud Messaging.
4. License to Use
Subject to payment of all amounts due, we grant the Customer a non-exclusive, non-transferable and revocable license to use the Products for the duration of the subscription or license purchased. Unless stated otherwise, a license is valid per site. Updates are provided during the active license period.
5. Relay Service and Google / Firebase Dependency
The Relay Service lets Customers send push notifications without configuring their own Firebase credentials. Access is activated by a valid license key bound to a site. The Service relies on Google and Firebase Cloud Messaging APIs: we are not liable for outages, changes, quotas or limitations imposed by Google. Use is subject to Google’s terms.
6. Access, License Keys and Security
The Customer is responsible for keeping its license keys and credentials confidential. A key is bound to the first site that activates it. Any fraudulent use, unauthorized sharing, or attempt to circumvent technical limits may result in suspension or termination without refund.
7. Acceptable Use
The Customer agrees not to use the Products to:
- send unlawful, deceptive, defamatory, hateful content or spam;
- send notifications to people who have not validly consented to receive them;
- circumvent technical measures, overload or disrupt the Service;
- breach Google/Firebase rules or any applicable law.
8. Personal Data and GDPR Roles
The processing of personal data is described in our Privacy Policy. The Customer is the data controller for its Subscribers’ data and agrees to obtain valid consent to notifications, provide compliant notices (GDPR/ePrivacy, and equivalent laws such as the CCPA where applicable) and handle data-subject requests. For such data, we act as a data processor.
9. Fees, Subscription and Commercial Termination
Pricing, billing, renewal and refund terms are governed by the General Terms and Conditions of Sale. Non-payment may result in deactivation of the Products or the Relay Service.
10. Intellectual Property
The Products, the Relay Service and all their components remain our exclusive property or that of our licensors. The license granted transfers no intellectual property rights. Third-party components (e.g. open source) remain subject to their respective licenses.
11. Warranties and Liability
The Products and the Service are provided “as is”, without warranty of uninterrupted availability or fitness for a particular purpose. To the extent permitted by law, our total liability is limited to the amount paid by the Customer in the last 12 months and excludes indirect damages (loss of data, revenue or reputation).
12. Suspension and Termination
We may suspend or terminate access for breach of these Terms. The Customer may stop using the Products at any time; commercial termination terms are set out in the Terms and Conditions of Sale.
13. Changes
We may amend these Terms at any time. The applicable version is the one online at the time of use; continued use constitutes acceptance.
14. Governing Law and Jurisdiction
These Terms are governed by French law. Any dispute falls under the competent courts of Perpignan, subject to mandatory consumer-protection provisions.
